Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of WeTalkPal's website, applications, and related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service
WeTalkPal provides AI-powered English speaking practice, including conversational simulations, pronunciation feedback, progress tracking, and gamified learning features. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
Eligibility & Accounts
You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized use.
Subscriptions & Billing
Certain features require a paid subscription. Prices, billing cycles, and included features are displayed at the time of purchase. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled according to the policies of your app store or payment provider and applicable law. Free-tier usage limits may change with reasonable notice.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Attempt to reverse engineer, scrape, or interfere with the Service or its infrastructure.
- Share harmful, abusive, harassing, or infringing content during conversations.
- Create multiple accounts to abuse free-tier limits or promotional offers.
- Impersonate others or misrepresent your affiliation with any person or entity.
AI Features & Limitations
AI-generated responses and feedback are provided for language learning purposes only. They may contain errors and should not be relied upon for professional, legal, medical, or other critical decisions. WeTalkPal does not guarantee specific learning outcomes or fluency improvements.
Intellectual Property
The Service, including its design, software, characters, content, and trademarks, is owned by WeTalkPal and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial learning. You retain ownership of content you submit, but grant us a license to process it as needed to provide the Service.
Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect and use your information, including voice and conversation data. Please review it at privacy.html.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses a risk to the Service or other users. Upon termination, your right to use the Service ceases immediately.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WETALKPAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER.
Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which WeTalkPal operates, without regard to conflict-of-law principles. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or courts of competent jurisdiction as required by applicable law.
Changes to Terms
We may revise these Terms from time to time. Material changes will be communicated via the Service or email where appropriate. Your continued use after the effective date of updated Terms constitutes acceptance. If you disagree with the changes, you must stop using the Service.
